ngRefer – Terms and Conditions

1. The Promoter is RWA People Limited of 666 Great South Road, Ellerslie, Auckland (“Promoter”).

2. This promotion is a Angular Developer Registration competition (“Promotion”) and is administered by the Promoter.

3. Entry into the Promotion is deemed acceptance of these Terms and Conditions. The winner may be required to sign acceptance of the Terms and Conditions prior to claiming the Prize (as defined below).

ELIGIBILITY

4. The Promotion is only open to natural persons who are New Zealand residents who fulfil the entry requirements.

5. The Promotion is not open to employees of the Promoter, their families or anyone associated with the Promotion. For the avoidance of doubt, contractors and clients are eligible to enter.

6. All participants of the Promotion must be at least 18 years old. The Promoter reserves the right to verify the age of participants.

ENTRY

7. The Promotion can be entered via the following ways.

(a) One entry will be given to each Angular developer who registers with RWA People by sending an email to info@rwa.co.nz and attaching their CV.

(b) One entry will be given when a participant via email to info@rwa.co.nz refers a friend or colleague who is also an angular developer. The email must include the name of the person being referred and either an email address or contact number.

(i) Multiple referrals of Angular developers can be made for multiple entries.

(ii) The entry will become valid only once the angular developer being referred sends in their CV to RWA People via email to info@rwa.co.nz.

(iii) The referred Angular developer will receive one entry for registering with RWA People as above.

8. Entries for the Promotion must be received between 09.00am on 6 April 2016 and 11.59 pm on 7 May 2016 (“Entry Period”). Entries received after this time or submitted by any other means (e.g. in the post) will not be accepted.

9. Any participant who is found to have entered the Promotion under multiple aliases shall be disqualified.

PRIZE DETAILS

10. The prize consists of the winners choice of either one of an Apple iPhone 6S or a Huawei Nexus 6P smartphone. Prize details are correct at the date of publication. The Promoter reserves the right to substitute the Prize with a prize of a similar nature or value if the Prize becomes unavailable for any reason.

11. The Prize must be taken as offered, may not be deferred, is non-transferable and cannot be redeemed for cash.

DRAWING PRIZE WINNERS, NOTIFICATION, AND REDRAWS

12. The winner of the Prize will be drawn, at random, from all eligible entries on 11 May 2016 by the Promoter (“Promotion Draw”). The Promoter’s decision is final and no correspondence will be entered into in relation to the winner of the Promotion Draw.

13. The Promoter will notify the winner of the Promotion by 5:00 pm on 11 May 2016 by telephone and/or email. Following receipt of such notification from the Promoter, if the winner of the Promotion accepts the Prize awarded to them, they must claim the Prize by 6.00 pm on 18 May 2016. If the winner is located in Auckland the winner must claim the prize from the Promoter’s office at the address specified under term 1. If the winner is located outside of the Auckland region, the Promoter will arrange postage at its expense. If the Prize is declined or unclaimed by a winner of the Promotion or if the winner cannot be contacted (as noted above) within 5 days of first attempting to notify the winner, the Prize will be forfeited. In such circumstances, the Promoter reserves the right to award the Prize to another participant, selected in accordance with these Terms and Conditions. Such winner will be notified by the Promoter in the same manner prescribed above. The Promoter shall not have any liability to a winner in the event that the winner is unable to take up their Prize.

14. Before receiving the Prize, the winner must provide acceptable identification (such as driver’s licence, passport or birth certificate). If the Prize is being posted to the winner that winner’s proof of address will also be required.

OTHER TERMS

15. The Promoter may withhold the Prize if it considers in its absolute discretion that: the participant does not meet the eligibility criteria; is in breach of these Terms and Conditions; or has acted contrary to the requirement of good faith. For the avoidance of doubt, only the person who entered the Promotion can be awarded the Prize.

16. By entering into the Promotion, participants acknowledge that failure to comply with the Terms and Conditions may result in immediate disqualification.

17. The Promoter will not be liable if the Prize or any parts of the Prize do not reach the Prize winners for reasons beyond the control of Promoter or if the Prize or any part of the Prize is damaged or destroyed during delivery.

18. If, for any reason, the entry to the Promotion is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, the Promoter reserves the right, at its discretion, to cancel, terminate, modify or suspend the Promotion.

19. The Promoter does not have any control over communication networks and will not be responsible for entries lost in transmission, or received late due to technical malfunction or otherwise.

20. Unless explicitly stated under these Terms and Conditions, all costs incurred by the winner, and any other expenses incurred while redeeming the Prize, will be at the expense of the winner.

21. In accepting the Prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the Promotion, including providing the Promoter with a photograph of the winner with the Prize within 5 days of receipt of the Prize. The winner agrees to grant the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media (including the Promoter’s Blog, Linkedin and Twitter pages) and the winner will not be entitled to any fee for such use.

22. Each participant acknowledges and agrees that:

(a) the Promotion is administered by the Promoter;

(b) the Promotion is in no way sponsored, endorsed, administered by, or associated with, Apple, Samsung or HTC; and

23. The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as it deems fit and the Promoter’s decision will be final and binding. No correspondence will be entered into. The Promoter expressly reserves the right to change or alter these Terms and Conditions at any time.

24. The Promoter reserves the right to refuse to award the Prize to any participant who the Promoter (in its sole discretion) believes has gained an unfair advantage in participating in the Promotion or won using fraudulent means.

25. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any participant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking the Prize, except for any liability that cannot be excluded by law.

26. Participants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion and publicise the winner. The personal information of the winner may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, and prize suppliers and deliverers. Persons may contact the Promoter by post at the address set out in paragraph 1 to request access to, or correction of, any of their collected personal information that is held by Promoter.

27. Any tax which a winner may be required to pay under New Zealand law on any Prize awarded pursuant to the Promotion shall be the responsibility of that participant.

28. All trade marks, text, images, and logos relating to the Promoter or third parties involved in this Promotion and used in relation to it, are the exclusive property of the Promoter or those third parties and participation in the Promotion does not confer any rights to a participant in or over or grant any right to use these.

29. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms and conditions shall continue in full force and effect.

30. These Terms and Conditions and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with New Zealand law. Disputes arising out of or in connection with either the Promotion or these Terms and Conditions shall be subject to the exclusive jurisdiction of the New Zealand courts.
